Overview of Terms & Agreement to Terms

These Terms of Service (“Terms”) govern the use of the RoloDEQ app, operated by HoloDEQ, LLC (“we,” “our,” or “us”), effective as of November 1, 2024. By accessing or using the RoloDEQ app, users (“you” or “your”) agree to comply with these Terms.

The purpose of these Terms is to:

• Establish guidelines for acceptable use of the app;
• Outline limitations on usage and user responsibilities;
• Protect the intellectual property rights of RoloDEQ, ensuring users do not replicate, adapt, or resell its content without permission.

Your continued use of the RoloDEQ app signifies your agreement to these Terms and our Privacy Policy. Please review them carefully before using the app.

 

User Eligibility

To use the RoloDEQ app, you must be at least 13 years old. The app is intended for U.S. residents only, and by accessing or using the app, you confirm that you meet this age requirement and are accessing it from within the United States

The app is designed solely for personal, non-commercial use. Non-human or automated access, including bots, scrapers, and other automated systems, is strictly prohibited. Additionally, any attempt to appropriate, replicate, or adapt the app’s content or intellectual property for commercial purposes without express authorization is not permitted.

 

Account Creation and Security

To access certain features of the RoloDEQ app, users must create an account by providing their name, email address, and birthdate. By creating an account, you agree to provide accurate, current, and complete information.

We require users to create strong passwords and may prompt you to reset your initial password for added security. You are solely responsible for maintaining the confidentiality of your account credentials and for any activity that occurs under your account. If you suspect any unauthorized use of your account, you must promptly notify us.

 

User Responsibilities, Conduct, and Restrictions

As a RoloDEQ user, you agree to use the app and its community forum in a manner that is respectful and constructive, fostering a helpful environment for career-related discussions. We expect users to adhere to a standard of professionalism and helpfulness within the community.

 

Prohibited Conduct: The following actions are strictly prohibited:

• Harassment, hate speech, or discriminatory remarks
• Spamming, including unsolicited advertising or promotions
• Sharing inappropriate or offensive content
• Any behavior that disrupts the constructive nature of the community
• Attempting to reverse-engineer, decompile, or access the app’s underlying code, data schemas, or algorithms
• Using automated systems, such as bots or crawlers, to access or extract data from the app
• Engaging in any unauthorized commercial use or exploitation of the app or its content, including any use that competes with or undermines the revenue potential of RoloDEQ

We reserve the right to suspend or terminate user accounts for conduct violations. Generally, one warning will be issued prior to suspension or termination; however, HoloDEQ, LLC reserves the right to take action at its sole discretion.

 

Intellectual Property Rights

All content, design, functionality, and features of the RoloDEQ app are the exclusive property of HoloDEQ, LLC and are protected by intellectual property laws. Users may not copy, modify, distribute, or sell any part of the app or its content without express written permission from HoloDEQ, LLC.

User-Generated Content: By submitting or creating content within the app, you grant HoloDEQ, LLC a non-exclusive, perpetual, royalty-free license to use, display, reproduce, modify, and adapt your content as necessary to provide and improve the RoloDEQ service. This license enables us to conduct research, derive insights, and develop advanced features related to analytics, prediction, and modeling to enhance our offerings. Even if you delete your account or your membership lapses, HoloDEQ, LLC reserves the right to retain anonymized or aggregated data, including community contributions, for these purposes. Such contributions may be retained indefinitely in anonymized or aggregated form to support platform integrity, community insights, and product improvements.

Content and Data Ownership

Users retain ownership of the personal information and content they create or submit within the RoloDEQ app. By using the app, you acknowledge that HoloDEQ, LLC retains a license to use, modify, and display this content in anonymized or aggregated form as necessary to provide and improve the RoloDEQ service, including for purposes such as research, analytics, and the development of advanced features.

Data generated through interactions with the app—such as usage patterns and engagement metrics—is owned by HoloDEQ, LLC and may be used to enhance and optimize the service. Users have the right to delete their accounts, and upon doing so, identifiable personal information will be removed. However, certain anonymized or aggregated data may be retained to support ongoing research and service improvements.

Note for Users in Specific Jurisdictions: Users in certain jurisdictions may have additional data rights under local laws.

Data Privacy and User Information

RoloDEQ collects and uses user information to provide, improve, and secure the app and its community features. By using the app, you agree to the collection and use of the following types of data:

• Personal Information: RoloDEQ collects personal information such as your name, email address, and birthdate to manage accounts and provide a personalized experience.
• Usage Data: We collect information about how you use the app, including interaction data and engagement metrics, to support service improvements and optimize user experience.
• Content Created within the App: Content you create, submit, or share within the app, including in the community forum, may be used to facilitate and moderate interactions, enhance safety, and improve community engagement.

 

Data Usage: RoloDEQ uses your data for purposes such as research, analytics, and the development of advanced features, as well as for app updates, security, user support, moderation, and improving community engagement. RoloDEQ will never sell your personal information.

 

Third-Party Sharing: We may share data with third parties in limited cases, such as app analytics, payment processing (e.g., Stripe), and compliance with any legal requirements. These third parties are subject to their own privacy policies and Terms of Service.

 

User Rights: Users have the right to access, update, and request deletion of their personal information. Upon account deletion, identifiable personal data will be anonymized, though RoloDEQ may retain anonymized or aggregated data to support service improvements and research initiatives.

 

Payment Terms

Access to the RoloDEQ app is available exclusively through a paid membership, which may be purchased separately or bundled with a digital course offering. By purchasing a membership, you agree to the following payment terms:

• Subscription Renewal: App memberships renew automatically based on the selected term (e.g., monthly or yearly) until canceled. Users can manage or cancel their membership through the Kajabi portal.
• Refund Policy: RoloDEQ offers a 14-day full refund policy for app-only memberships. For bundled course offerings, refunds are available if the course has not been completed or at our discretion.

 

Third-Party Links and Content

RoloDEQ allows users to input personal reference links, such as LinkedIn URLs, for private use. Additionally, users may share links to external content (e.g., articles, resources) within the community forum to facilitate discussions. HoloDEQ, LLC does not endorse, verify, or monitor any third-party links or content shared by users in the forum. Any reliance on or engagement with such content is the user’s sole responsibility.

HoloDEQ, LLC assumes no liability for the content, accuracy, or practices of any third-party sites referenced by users. Users are advised to independently assess any third-party information before engaging with it.

 

Disclaimer of Warranties and Limitation of Liability

RoloDEQ is committed to providing reliable access to the app, dependent on the capacity and operations of our infrastructure partners. However, we do not guarantee continuous, uninterrupted, or error-free service, and we disclaim any specific promises regarding service availability.

The content provided within RoloDEQ, including user-shared information, is for informational purposes only. HoloDEQ, LLC does not warrant the accuracy, completeness, or reliability of any content in the app and assumes no responsibility for errors or omissions.

To the fullest extent permitted by law, HoloDEQ, LLC disclaims liability for any direct, indirect, incidental, consequential, or special damages arising from your use of, or inability to use, the RoloDEQ app. This limitation of liability applies regardless of the form of action, including contract, tort, negligence, or strict liability, and is governed by the laws of the state of Illinois.

 

Indemnification

You agree to indemnify, defend, and hold harmless HoloDEQ, LLC, its affiliates, and their respective officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees and costs, arising out of or in any way connected to:

• Your use or misuse of the RoloDEQ app;
• Any violation of these Terms by you;
• Any content you share or actions you take within the app, including but not limited to defamatory or misleading statements, data misuse, or inappropriate conduct.

This indemnification obligation applies regardless of the form of action and will survive the termination of your account or use of the app.

 

Modifications to Terms

HoloDEQ, LLC reserves the right to modify or update these Terms as new features or changes to the RoloDEQ app are introduced. When updates are made, we will notify users by email, and the revised Terms will be accessible on our website and linked within the app.

Your continued use of the RoloDEQ app following any changes to these Terms constitutes acceptance of the updated Terms. We encourage you to review these Terms periodically to stay informed of any modifications.

 

Termination of Service

HoloDEQ, LLC reserves the right to suspend or terminate your access to the RoloDEQ app under the following conditions:

• Violation of these Terms, including prohibited conduct or misuse of the app;
• Non-payment or failure to renew your membership at the end of your current term;
• At HoloDEQ’s discretion, to protect the integrity and safety of the RoloDEQ community.

In cases of termination, users will immediately lose access to their accounts and any associated data. As outlined in our data policies, anonymized or aggregated data may be retained for research and service improvements.

 

Governing Law and Dispute Resolution

These Terms and any disputes arising from your use of the RoloDEQ app are governed by the laws of the State of Illinois, without regard to its conflict of laws principles. By using the app, you agree to submit to the exclusive jurisdiction of Illinois for any matters not resolved through arbitration.

 

Binding Arbitration: Any and all disputes, claims, or controversies arising out of or relating to these Terms or your use of the RoloDEQ app shall be resolved through binding arbitration. Arbitration will be conducted by a neutral arbitrator and administered in accordance with the rules of the American Arbitration Association or a similar organization. The decision of the arbitrator will be final and binding, with limited rights of appeal.

 

Class Action Waiver: You agree to resolve any disputes with HoloDEQ, LLC on an individual basis and waive your right to participate in a class, collective, or representative action against us.

This section applies to the fullest extent permitted by applicable law and survives the termination of your account.

 

General Provisions

Entire Agreement: These Terms, along with any other policies or agreements expressly referenced, represent the entire agreement between you and HoloDEQ, LLC regarding your use of the RoloDEQ app and supersede any prior agreements or understandings.

Severability: If any provision of these Terms is found to be invalid or unenforceable, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will continue in full force and effect.

No Waiver: The failure of HoloDEQ, LLC to enforce any right or provision of these Terms will not be deemed a waiver of that right or provision.

Assignment: You may not assign these Terms or any of your rights under them without prior written consent from HoloDEQ, LLC. We may assign these Terms, including any rights and obligations, at our discretion.
